There is a practical reason this matters more in tax work than in most fields. A tax conversation is a conversation about money you may not have, deadlines you cannot move, and a federal agency with the power to collect. Understanding it approximately is not good enough.

What "bilingual" means here, and what it usually means elsewhere

Plenty of offices say they speak Spanish. Often that means one person at the front desk translates while someone else does the work, and the person actually preparing your return never speaks to you directly. The gap shows up in the details — a question you did not know how to ask, a document you did not know counted, a letter you signed without fully reading.

The IRS works in Spanish too — more than most people know

You have rights here that are easy to miss, and using them costs nothing:

  • Written correspondence in your language. Schedule LEP (Form 1040), "Request for Change in Language Preference" (Rev. December 2024), lets you tell the IRS which language you want its written communications in. There are currently twenty language choices. It is filed with your return — that is the only way to state the preference — and it can be filed with the current year's return or any later one, but not for a year before 2020.
  • Telephone help. The IRS instructs Spanish speakers: "For Spanish, call 800-829-1040." For everything else there is one number, not a short list of languages: "For all other languages, call 833-553-9895." An assistor can "provide an interpreter over the phone," and the IRS says taxpayers "can access interpreters in more than 350 languages" when dealing with its employees over the phone or face-to-face (IRS, Let us help you; IRS, Find tax help in several languages on IRS.gov). Separately, IRS.gov's own content is translated into seven languages: Spanish, Chinese (Simplified), Chinese (Traditional), Korean, Russian, Vietnamese and Haitian Creole.
  • Forms in Spanish. An ITIN application, for example, can be filed on Form W-7(SP) (Instructions for Form W-7, Rev. December 2024).

One honest caveat about Schedule LEP, because it disappoints people who expect it to work immediately: the IRS is translating its notices on a multi-year timeline, and until a given notice is translated you keep receiving it in English. Filing the schedule sets your preference; it does not flip a switch.

What does not change

The language you file in is more flexible than most people expect. The IRS publishes Form 1040 (sp), "Declaración de Impuestos de los EE. UU. sobre los Ingresos Personales" — the individual return itself, in Spanish, with Spanish instructions to match (Form 1040 (sp) (2025); Instructions for Form 1040 (sp)). Not every federal form has a Spanish counterpart, so part of the job is knowing which ones do. What does not change is the law underneath: the rules are identical either way, and so are the deadlines. Nobody gets a different set of rules for filing in a second language.

What changes is whether you understood the decisions made on your behalf, and whether you can ask a real question and get a real answer.

Documents that arrive in Spanish

Income and asset records rarely show up in tidy English. Foreign bank statements, property documents from another country, invoices from a family business, an identity document from a consulate — these are ordinary here, not an exception we accommodate. We read them and tell you which ones the IRS will take as they are. The translation rule is narrower than people assume: for an ITIN application the IRS does not demand a certified translation up front, but warns that you "may later be required by the IRS to provide a certified translation of foreign-language documents." A power of attorney is the one case with no give in it — submitted in another language it "will be considered invalid unless accompanied by a certified English translation" (Instructions for Form W-7, Rev. December 2024).

Why the credential matters more, not less, in a second language

An Enrolled Agent is licensed by the IRS and holds, in the agency's own words, "unlimited practice rights" — no restriction on which taxpayers they represent, what matters they handle, or which IRS office they appear before (IRS, Enrolled Agent Information). Someone who only fills in forms stands in a much narrower place: a preparer holding just a PTIN has had, since January 1, 2016, "no authority to represent clients before the IRS," and one who joins the Annual Filing Season Program gets limited rights only — returns they prepared and signed, before "revenue agents, customer service representatives, and similar IRS employees," and never "regarding appeals or collection issues" (IRS, Understanding Tax Return Preparer Credentials and Qualifications).

That distinction gets sharper when English is not your first language, because the moment something goes wrong is exactly the moment the vocabulary turns technical. Being able to hand the problem to someone who can argue it with the IRS and explain it to you in Spanish is the whole point.
